Hi All,

Hope you are all doing well.

Just a quick question - my wife is currently in the UK on a spouse visa, but we were thinking of going to Italy for a 2 week holiday in the Summer - can we apply for a Schengen visa from the UK with a spouse visa?

I had a look on the UKBA and it said only ILR'ers can apply this seems very odd and a little worrying.

Your wife should have no problem applying for a Schengen visa in the UK.

A Spouse visa is a residency visa so therefore your wife can apply for a Schengen visa in the UK, she will need to supply a copy of her Spouse visa as proof that she is legally resident in the UK.

 

Click this link http://www.theschengenvisa.co.uk/how-do-i-apply/what-documents-do-i-need and scroll down to section 4, because your wife is married to a EU citizen you can ignore section 6 and when filling out the Schengen visa form pay attention to the fields marked with a * (they do not have to be filled in) and be sure to complete fields 34 & 35.

Last but not least because your wife is married to an EU citizen the visa should be issued free of charge (this does not include any VAC charges if you go through a Visa Application Centre).
